Terms of Service

Pocket Mom is run by Cloud Path Strategies LLC, doing business as Pocket Mom. By using it you agree to these terms. If you do not agree, please do not use it.

Pocket Mom is not therapy, and not a crisis service

Pocket Mom is a companion app. It sends warm messages that were written in advance by a person. It is not therapy, counselling, medical advice, psychiatric care, or any kind of professional service, and nothing it says should be treated as any of those. Nobody reads your check-ins and replies to them. Nobody is monitoring your account.

Pocket Mom cannot help in an emergency. It does not detect crisis, it does not alert anyone, and messages are scheduled rather than answered in real time.

If you are in crisis or thinking about harming yourself, please contact someone who can actually help, right now. In the United States you can call or text 988 to reach the Suicide & Crisis Lifeline, any hour of any day, or chat at 988lifeline.org. If someone is in immediate danger, call 911. Outside the US, contact your local emergency number or crisis line.

Using Pocket Mom is never a reason to delay getting real help, and it is not a substitute for a doctor, a therapist, or a person who loves you.

Who can use it

You need to be at least 13 years old. If you are under 18, please use Pocket Mom with a parent or guardian's knowledge. You may only create an account for yourself, using an email address you control.

Your account

We sign you in with a one-time code sent to your email, so there is no password. That makes your email account the key to your Pocket Mom account: keep it secure, and tell us if you think someone else has access. You are responsible for what happens under your account.

What you put in

Your events, the feelings you tap, and anything you save stay yours. We do not claim ownership of them. We use them only to run the service, as described in our Privacy Policy, and we do not sell them.

Please do not use Pocket Mom to store information about other people, to break the law, to attack or overload the service, or to try to reach accounts that are not yours.

What we put in

Pocket Mom's messages, Jennie Pig, the name, the artwork and the software belong to Cloud Path Strategies LLC. You are welcome to read them, screenshot them, and share something that helped you. You may not copy the collection wholesale, resell it, or pass it off as your own.

The service will not be perfect

We may change, pause, or stop Pocket Mom at any time. Check-ins may arrive late, arrive twice, or not arrive at all — email can fail, servers can go down, and a bug can miss a day that mattered to you. We are sorry in advance when that happens, and we cannot promise it will not. Do not rely on Pocket Mom as a reminder for anything important, medical or otherwise.

No warranties

Pocket Mom is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any message will suit your situation.

Limitation of liability

To the fullest extent permitted by law, Cloud Path Strategies LLC and anyone working with it will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or emotional distress, arising out of or relating to your use of Pocket Mom — even if we have been advised that such damages are possible.

Our total liability for all claims relating to Pocket Mom will not exceed the greater of one hundred US dollars ($100) or the total amount you paid us in the twelve months before the claim arose.

Some places do not allow some of these exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

Indemnification

You agree to indemnify and hold harmless Cloud Path Strategies LLC from claims arising out of your misuse of Pocket Mom or your breach of these terms.

Ending it

You can delete your account at any time from Your Corner, and everything attached to it goes with it. We may suspend or close an account that is being used to harm the service or another person. The sections on warranties, liability and indemnification survive.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules, and any dispute will be brought in the state or federal courts located there.

Changes

If we change these terms we will update the date at the top, and tell you by email if the change is significant. Continuing to use Pocket Mom after that means you accept the new version.
